Foreclosures, contests and demands presented by dismissal decreased during the second quarter of the year, the effects of the economic crisis report on the courts of the General Council of the Judiciary.

General decline in proceedings in court. This is the conclusion that can be reached by observing the figures in the report Effects of the economic crisis in the judiciary, prepared by the Statistics Section of the General Council of the Judiciary (CGPJ).

Among the most relevant data, it is noteworthy that the number of lawsuits filed in court dismissal of the social in the second quarter of 2015 decreased 9% over the same period last year, to the 26,417, so they accumulate and eight consecutive quarters of declines.

As specified by the study, Madrid remains the autonomous region where most demands for dismissal were recorded: 4,948, representing 18.7% of the national total. It is followed by Catalonia with 17.4% -the 4,585 – and 4,125 Andalusia, 15.6%.

On the other hand, it specifies that the CGPJ social courts received in the months of April, May and June amount 32.948 claims, 4.5% less than in the same period of 2014.

By provinces, 5,570 were recorded in Madrid, 16.9% of the total; Andalusia 4,645 (13.8%) and Catalonia 4,072 (13.3%).

Competitions

As the number of tenders submitted during the study period were 1,593, says the report which is the lowest registered since the third quarter of 2010 and a decrease of 25.3% from the second quarter last year.

Catalonia, with 312, is the territory with more contests presented in the second quarter, representing 19.6% of the national total. -263 Followed Madrid, 16.5% – -243 and Valencia, 15.3% -.

It notes that the CGPJ has also decreased by 23.9% the number of competitions declared: in the second quarter of 2015 were reported 1,166, to which must be added another 268 declared and concluded under Article 176 bis 4 of the Bankruptcy Act which provides for the conclusion of insufficient mass in the same order declaring the contest.

In addition, between April 1 and June 30 last they reached the stage of agreement a total of 305 competitions, while the liquidation phase began 1,145, 19.6% less than in the same period of 2014.

In the second quarter, finally, 224 dossiers of Article 64 of the Bankruptcy Act on the substantial change in working conditions is presented collective character. The figure represents a decrease of 33.5% over 2014, and the eighth consecutive quarter of decline.

Releases

The decline is least regard to the practiced shooting in the second quarter, which was 18 739, only ten less than the 18,749 in the same period of 2014. The releases affect different types of properties, not only housing and in the case of the latter, not only residence.

The total releases practiced, more than half 9858, 52.6% – were the result of proceedings arising from the Law of Urban Leases (LAU); 8.120 -the other words, 43.3% – was derived from foreclosures and the remaining 761 are due to other causes.

Regarding data from the second quarter of 2014, it shows that the releases arising from procedures regulated in the LAU decreased 1.2%; while those resulting from foreclosures have increased 2.7%.

By region, it is noteworthy that 23% occurred in Catalonia; 16.4% in Andalusia; 14.3% in Valencia; and 10.6% in Madrid.

As for the consequences, Andalusia represents the highest percentage of the launch that result from foreclosures, with 20% of the national total, followed by Valencia (18.6%) and Catalonia (18.4%).

However, Catalonia is the region with more releases derived from LAU, with 27%, followed by Madrid (14.3%) and Andalucía (13.2%).
